Summary

If you received a prerecorded message telemarketing call regarding home security systems, you may be a member of a class action lawsuit against NorthStar Alarm Services, LLC and Yodel Technologies LLC (“Defendants”). The lawsuit alleges that Defendants violated the Telephone Consumer Protection Act by placing prerecorded telemarketing calls regarding home security systems to residential telephone numbers.

This website contains information regarding the Settlement of the Class Action case Braver v. NorthStar Alarm Services, LLC, et al. No. 5:17-cv-00383-F (W.D. Okla.).  The lawsuit alleged that Defendants violated the Telephone Consumer Protection Act (“TCPA”) based on prerecorded message telemarketing calls to residential telephone numbers regarding home security systems.  The TCPA permits a plaintiff to recover $500 per call found to violate the law, and up to $1,500 per call if the violation is found to be knowing or willful. Defendants deny the plaintiff’s allegations.

The Court certified the following class and sub-class on October 15, 2018:

Class:

All persons in the Red Dot Data marketing list for whom Yodel’s records reflect a telephone call regarding Northstar’s home security systems that lasted more than 30 seconds, that was handled by an agent who applied status code 20 or 50 to the call, and that resulted in the normal clearing disposition.

Subclass:

All persons in the Red Dot Data marketing list for whom Yodel’s records reflect a telephone call regarding Northstar’s home security systems that lasted more than 30 seconds, that was handled by an agent who applied status code 50 to the call, and that resulted in the normal clearing disposition.

Excluded from the class are:  any persons whose contact information is associated with either an IP address or website URL in the Red Dot Data marketing list..

Postcards were sent on July 21, 2020 to the Class and Subclass.  The deadline to respond to the postcard notice is September 19, 2020.

The claimant distribution is scheduled for January 29, 2021.
